OnlineTickets.ie - Event Organiser Agreement

This Event Organiser Agreement (“Agreement”) governs the use of the OnlineTickets.ie platform by any person or entity listing or promoting events (“Organiser”, “you”).

By creating an organiser account or listing an event, you agree to be legally bound by this Agreement.


1. Definitions

“Platform” means the OnlineTickets.ie website, software and related services.

“Event” includes concerts, performances, community events, sporting events, bingo, raffles, prize draws or similar activities.

“Organiser Merchant Model” means where the Organiser uses its own Stripe, PayPal or other payment account.

“Platform Merchant Model” means where payments are processed through OnlineTickets.ie’s merchant account.

“Service Fees” means the fees payable to OnlineTickets.ie for use of the Platform.


2. Role of OnlineTickets.ie

OnlineTickets.ie provides ticketing technology and, where applicable, payment processing services.

OnlineTickets.ie does not organise, promote, control or deliver Events.

The Organiser is solely responsible for:

  • Event planning and delivery
  • Venue arrangements
  • Licensing and permits
  • Insurance
  • Health and safety
  • Compliance with all applicable laws
  • Prize fulfilment (for bingo, raffles or draws)

Where payments are processed by OnlineTickets.ie, we act as a disclosed agent for the Organiser only.

The contract for attendance at the Event is between the Organiser and the ticket buyer.


3. Payment Models

3.1 Organiser Merchant Model

Where the Organiser uses its own Stripe, PayPal or other payment provider:

  • The Organiser is the merchant of record.
  • Customer funds are processed directly by the Organiser’s payment provider.
  • OnlineTickets.ie receives Service Fees via split payment or invoice.

Under this model:

  • The Organiser is fully responsible for all refunds.
  • The Organiser is fully responsible for all chargebacks.
  • The Organiser bears all fraud risk.
  • OnlineTickets.ie does not hold or control customer funds.

3.2 Platform Merchant Model

Where payments are processed through OnlineTickets.ie’s merchant account:

  • OnlineTickets.ie acts as disclosed agent for the Organiser.
  • Funds are held pending settlement.
  • Settlement normally occurs after the Event.

OnlineTickets.ie may:

  • Withhold settlement until after the Event.
  • Retain a rolling reserve against refund or chargeback risk.
  • Deduct refunds, disputes, regulatory penalties or unpaid fees.
  • Delay settlement where fraud, compliance or financial risk is identified.

The Organiser remains financially responsible for:

  • All refunds
  • All chargebacks
  • All event-related liabilities

If refunds or chargebacks exceed retained funds, the Organiser must repay the balance within 7 days of demand.


4. Refunds and Event Cancellation

The Organiser must:

  • Clearly publish refund and cancellation policies.
  • Honour cancellation or rescheduling obligations.
  • Ensure sufficient funds are available to process refunds.

Failure to fund refunds constitutes a material breach of this Agreement.

OnlineTickets.ie may recover unpaid amounts as a debt.


5. Compliance and Licensing

The Organiser warrants that:

  • The Event complies with all Irish laws.
  • All required licences and permits are obtained.
  • Appropriate insurance cover is in place.
  • The Event does not infringe intellectual property rights.
  • All advertising is lawful and not misleading.

OnlineTickets.ie may request documentary proof of compliance at any time.


6. Bingo, Raffles and Gaming Events

Where an Event involves bingo, raffles, prize draws or similar gaming activity:

The Organiser warrants that:

  • The Event complies with the Gaming and Lotteries Act 1956 and any successor legislation.
  • All prize limits, licensing requirements and regulatory obligations are satisfied.
  • Participation is restricted to jurisdictions where lawful.
  • All prizes are genuine and available.

OnlineTickets.ie reserves the right to:

  • Suspend or remove gaming-related Events.
  • Request licence documentation.
  • Geo-restrict access.
  • Withhold settlement where regulatory risk exists.

The Organiser indemnifies OnlineTickets.ie against all regulatory fines, enforcement actions or claims arising from gaming non-compliance.


7. White-Label Domains

Where the Organiser connects its own domain name to the Platform:

  1. The Platform remains operated and controlled by OnlineTickets.ie.
  2. The Organiser remains solely responsible for the Event.
  3. The Organiser must clearly display:
    • Its full legal name
    • Contact details
    • Refund policy
    • Licensing disclosures (where applicable)
  4. A footer attribution must appear stating:

“Ticketing platform provided by OnlineTickets.ie”

  1. The Organiser may not:
    • Represent OnlineTickets.ie as the Event organiser.
    • Remove or modify mandatory legal disclosures.
    • Replace Platform legal documents.
  2. The Organiser indemnifies OnlineTickets.ie against any claims arising from branding, representations or omissions on the white-label domain.

OnlineTickets.ie may suspend white-label access where legal or regulatory risk arises.


8. Data Protection

Each party acts as an independent data controller in respect of buyer data relating to its own purposes.

The Organiser:

  • May access only buyer data relating to its own Events.
  • Must comply with GDPR and the Data Protection Act 2018.
  • Must not use buyer data for unrelated marketing.
  • Must honour unsubscribe requests.

OnlineTickets.ie may send event-related communications on behalf of the Organiser. The Organiser remains responsible for the lawfulness of such communications.

The Organiser indemnifies OnlineTickets.ie for breaches of data protection law arising from misuse of buyer data.


9. Fees

Service Fees are as agreed at onboarding.

OnlineTickets.ie may amend fees on notice for future Events.

Unpaid invoices may result in suspension.


10. Indemnity

The Organiser shall indemnify and hold harmless OnlineTickets.ie, its directors, officers and employees against any claims, losses, damages, fines, chargebacks or legal costs arising from:

  • Event cancellation
  • Injury or damage at the Event
  • Refund disputes
  • Fraud
  • Regulatory breaches
  • Gaming law violations
  • Misleading advertising
  • Data protection breaches by the Organiser

This indemnity survives termination.


11. Limitation of Liability

Nothing excludes liability where unlawful.

Subject to that:

OnlineTickets.ie’s total liability in connection with an Event is limited to the Service Fees earned in respect of that Event.

OnlineTickets.ie is not liable for:

  • Loss of profit
  • Reputational damage
  • Indirect or consequential loss

12. Suspension and Termination

OnlineTickets.ie may suspend or terminate access where:

  • Excessive chargebacks occur.
  • Fraud is suspected.
  • Regulatory risk arises.
  • This Agreement is breached.

Termination does not remove the Organiser’s financial obligations.


13. Governing Law

This Agreement is governed by the laws of Ireland.

Disputes are subject to the exclusive jurisdiction of the Irish courts.
